Welcome to Essence Flight. These Terms of Service ("Terms") govern your use of our website, facilities, aircraft, flight instruction, and training programs. By accessing our website or enrolling in our programs, you agree to be bound by these Terms.

If you do not agree to these Terms, you may not use our services or participate in our flight training programs.

Acceptance of Terms

By using our website or enrolling in training, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms form a legally binding agreement between you and Essence Flight.

Essence Flight reserves the right to modify these Terms at any time. Continued use of our services after changes are posted constitutes acceptance of the revised Terms.

Eligibility Requirements

To participate in flight training with Essence Flight, you must:

• Meet FAA age requirements for the applicable certificate
• Be able to read, speak, write, and understand the English language
• Hold a valid FAA medical certificate (or be eligible to obtain one)
• Provide valid government-issued identification
• Meet TSA / AFSP requirements if you are a non-U.S. citizen
• Comply with all FAA regulations and safety standards

Enrollment and Registration

Application Process

• Completion of an enrollment or training request
• Submission of required documentation
• Payment of applicable fees or deposits
• Acceptance by Essence Flight

Accurate Information

You agree to provide accurate and complete information. Providing false or misleading information may result in suspension or termination of training without refund.

Payment Terms

Tuition and Fees

Students are responsible for all training costs, including aircraft rental, instructor time, fuel surcharges, materials, and applicable taxes. Payment must be kept current to continue training.

Late Payments

Accounts with outstanding balances may result in suspended training privileges until balances are paid in full.

Cancellations, No-Shows, and Refunds

Lesson Cancellations

A minimum of 24 hours’ notice is required to cancel or reschedule a lesson.

No-Show Policy

Failure to appear at the scheduled time (no-show) or cancellations made with less than 24 hours' notice will result in the forfeiture of the full scheduled rate for the lesson or the loss of any prepaid booking deposit.

Withdrawal

Refunds for unused prepaid balances may be issued at Essence Flight’s discretion, less any applicable administrative fees.

Safety and Risk Acknowledgment

Flight training involves inherent risks. By enrolling, you acknowledge and accept these risks and agree to follow all safety instructions, FAA regulations, and instructor guidance.

Aircraft Weight and Balance

For flight safety and FAA compliance, all aircraft operate within strict maximum gross weight and center of gravity limitations.

• Students and passengers are required to provide accurate body weights prior to any scheduled flight.
• Essence Flight reserves the right to cancel or reschedule any flight if the total aircraft weight exceeds safe operational limits or manufacturer specifications.
• By proceeding with your booking, you confirm that you meet the weight requirements provided for the specific aircraft assigned to your training and acknowledge this by checking the mandatory acceptance box during the checkout process.

Limitation of Liability

To the maximum extent permitted by law, Essence Flight shall not be liable for indirect, incidental, or consequential damages arising from participation in flight training or use of our services.

No Guarantee of Certification

Essence Flight does not guarantee that any student will successfully obtain a pilot certificate, rating, or pass any FAA examination. Certification depends on individual performance, proficiency, and regulatory requirements.

Scheduling and Availability

Training schedules are subject to aircraft availability, instructor availability, weather conditions, maintenance requirements, and other operational factors. Essence Flight does not guarantee specific completion timelines.

Promotions and Pricing

Promotional pricing, discounts, and special offers are subject to change without notice and may have specific eligibility requirements or expiration dates. Published pricing is not a guarantee of total training cost, which may vary based on student progress and additional required hours.

Governing Law and Jurisdiction

These Terms shall be governed by the laws of the State of California. Any disputes shall be resolved exclusively in the state or federal courts located in California.
